Terms of Service and License Agreement

IMPORTANT NOTICE: Please read these Terms carefully. By accessing or using the Platform (as defined below), you acknowledge that you have read, understood, and agree to be bound by these Terms.

1. Independent Declaration and Scope of Service

1.1 Non-Affiliation: The Platform (ppy.sb) is a third-party data statistics and interaction server developed and operated by an independent team. The Platform is not affiliated in any way with the original osu! game, its official operator ppy Pty Ltd, or its associated website ppy.sh.1.2 No Authorization: The Platform does not have any form of authorization, sponsorship, or endorsement from ppy Pty Ltd. The intellectual property rights of "osu!" and its related logos belong exclusively to their respective original owners.1.3 Limitation of Scope: The Platform solely provides network connection, game data reception, and statistical display services. The Platform does not develop, host, or distribute any game client programs, nor does it provide, index, or cache any game beatmaps or audio files.

2. Governing Law and Jurisdiction

2.1 These Terms are entered into by the Platform's operating team (hereinafter referred to as "we", "us", or the "Platform") and you (hereinafter referred to as the "User").2.2 The Platform is primarily operated in the Hong Kong Special Administrative Region of the People's Republic of China (HKSAR). Any dispute, claim, or controversy arising out of or relating to these Terms shall be governed exclusively by the laws of the HKSAR, without regard to its conflict of law principles, and shall be subject to the non-exclusive jurisdiction of the courts of the HKSAR.

3. Disclaimers and Data Warranties

3.1 "As Is" Basis: All services provided by the Platform are provided on an "AS IS" and "AS AVAILABLE" basis. To the maximum extent permitted by applicable law, we expressly disclaim all warranties, whether express or implied (including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement), and make no promises or warranties regarding the continuity, error-free operation, data integrity, or availability of the service.3.2 Data Loss: We are under no obligation to back up User data on the Platform. In the event of any data loss or corruption (including but not limited to accounts, scores, and Replays) caused by system failure, data corruption, cyberattacks, or any other reason, we shall not bear any responsibility for restoration or compensation.3.3 Termination of Service: We reserve the right to modify, suspend, or permanently terminate all or part of the Platform's services at any time, for any reason (including but not limited to external legal risks or force majeure), without prior notice to you. Upon termination of the service, you shall have no right to claim any form of compensation or damages from us.

4. Risk Isolation for Third-Party Content

4.1 Disclaimer of Source: You acknowledge and agree that the client programs you use to connect to the Platform, as well as the beatmaps and audio files you use to play the game locally, are obtained by you independently from third-party sources.4.2 Assumption of Liability: Given that the copyright ownership of third-party beatmaps and clients may be complex or subject to defects, you shall bear full and sole legal responsibility for any copyright infringement or other legal disputes arising from your downloading, installing, or using the aforementioned third-party files. We shall not be held liable in any way.4.3 No Obligation of Review: Given that the Platform does not receive, process, or store any beatmaps or audio files, we do not assume any form of review obligation or joint and several liability for the legality of such third-party files.

5. Content Moderation and Code of Conduct

5.1 Post-Hoc Review: The Platform currently does not have a comprehensive automated content moderation system in place. We reserve the right to manually select, review, and screen content published by Users (e.g., personal profiles) and behavioral records on the Platform after the fact.5.2 Actions Against Violations: If your behavior on the Platform violates the current laws and regulations of the HKSAR or the provisions of these Terms, we reserve the right to take measures, including but not limited to removing content, restricting functions, suspending access, or terminating your account, without prior notice.

6. Intellectual Property and Data License

6.1 Validity of Data: Game scores, rankings, and points generated by you within the Platform are valid only within the Platform itself, have no connection to the official ppy.sh server, and cannot be converted into official data.

6.2 Limited Display License (Personal Profiles and Avatars):Regarding the content you upload for personal display, such as avatars and articles on your personal profile, you only grant us a non-exclusive, royalty-free, and terminable license, limited to our caching, displaying, and distributing such content on relevant pages of the Platform.

Withdrawal: When you actively delete such content or deactivate your account, the aforementioned license shall terminate immediately (subject to brief residual caching by the system).

6.3 Full and Irrevocable License (Scores and Replays):Regarding the game scores and match replay files (e.g., .osr files) that you upload to the Platform via the client, you acknowledge that such data constitutes the core foundation for maintaining the community ecosystem of this server. Therefore, you grant us a perpetual, irrevocable, royalty-free, worldwide, and sublicensable license.We have the right to store, use, modify, catalog, analyze, publicly display, and distribute copies of such data.

Irrevocability: You explicitly acknowledge and agree that once such scores and Replay data are uploaded to the Platform, you cannot revoke the above license, in order to ensure the integrity of the Platform's leaderboards, statistics, and other functions.

7. Language and Conflict Resolution

7.1 These Terms are available in both Chinese and English. In the event of any conflict, ambiguity, or discrepancy between the two versions, the English version shall prevail.
